- This contract is based on the understanding that access, electricity and water will be available at all times and does not include unexpected contingencies, such as striking of solid rock, running sand, ground water, services or other contingencies or services.
- At all times, it remains the responsibility of the property owner to ensure that all necessary planning, conservation, tree and any further building regulations have been confirmed with, and where necessary the relevant approval has been granted. Touch of Magic will of course offer our full assistance, where necessary, to help the property owner gain the necessary approval.
- Whilst every care is taken, no responsibility will be taken for the loss of living water creatures, such as fish, or plant life during these operations.
- As we offer fixed price quotations (with the exception of 1. Above) any derivation from the specifications of this quotation by the customer, such as alterations to dimensions or design must be discussed on site, and costs confirmed before changes are commenced.
- Although every care is taken during the alteration of ground levels, no responsibility whatsoever can be taken for subsidence caused by factors beyond our control, such as excess ground water, drought or inadequate work carried out by others not representing Touch of Magic.
- We strongly recommend that areas newly turfed must be watered regularly during the first 6 weeks after laying. Pedestrian traffic must be kept to a minimum, so as not to cause the turf to undulate or to prevent bedding in.
- All plants and materials remain the property of Touch of Magic and the title of these goods does not pass to the purchaser until dull payment is received and cleared.
- Unless otherwise agreed in writing by a company director, all hard landscaping carries a workmanship warranty for 12 months, and plants for three months. These warranties only apply if adequate maintenance has been undertaken during the periods concerned.

Our Commitment
- At all times to carry out the work in a professional manner to cause the least noise disturbance possible, to our customers and their immediate neighbours.
- To follow the instructions agreed in this quotation and to immediately inform the customer, or their agreed agent, of any unexpected contingencies or necessary derivation from the work schedule agreed.
- To endeavour to complete the work before the estimated work duration, however, at no time will the job be rushed to an extent where the quality o the finished design or product will or could be compromised.
- We will conform to any necessary building regulations, or any other local authority or National regulations at all times, which have been obtained and shown to us by the property owner.
- Touch of Magic will carry a minimum of Ten Million pounds liability insurance at all times and are licensed waste carriers with the Environment Agency.
